Humanitarian and compassionate grounds apply to people with exceptional cases. These applications are an opportunity for an applicant to request the Immigration, Refugees and Citizenship Canada to waive the usual and regular requirements to apply for permanent residence under the law. An application on humanitarian and compassionate grounds can be made by persons who are in Canada without legal immigration status and who are inadmissible to Canada. The decision-maker considers multiple factors which include:

  • Applicant’s economic, social and family ties to Canada;
  • Duration of applicant’s stay in Canada;
  • The best interest of the child, if any;
  • Hardships in case applicant is denied stay in Canada as a permanent resident;
  • Integration of the applicant in the community and community involvement of the applicant; and
  • Applicant’s character and civil record.
